Defendant objected to the report and recommendation issued by the case’s Special Master after Plaintiff’s Motion to compel Defendant to search its files using Plaintiff’s list of search terms; Defendant specifically objected to using the term “L3”.

Resolution:

The court sustained in part and overruled in part Defendant’s objection to the report. The court ordered Defendant to use the search term “L3” with certain other terms to prevent the search to be too broad. The court held that Plaintiff’s termsĀ  related to other products not involved in the case but may be infringing fell outside the scope of discoverable information of Rule 26.
